“Governing Biodiversity in Brazil: Effectiveness, Sustainable Uses and Inclusiveness in the Access to Genetic Resources and Benefit-Sharing”
My dissertation aims to analyze the design and implementation the access and benefit sharing (ABS) governance system in Brazil. The milestone for ABS regulation is the Convention on Biological Diversity (CBD), approved in 1992, which established an international framework, defining rights and duties related to biodiversity management, conservation, and uses. The legal prerogatives established by the CBD sought to balance different interests and dimensions of the problems linked to genetic resources, dealing with divergences between developed and developing countries (Pauchard, 2017). Historically, countries in the global north have been responsible for economically exploiting natural resources, often establishing colonial relationships with territories endowed with vast biodiversity, and have developed a greater capacity to produce science and technology based on genetic resources. In turn, developing countries felt unjustly treated because the genetic resources of their territories were exploited, without being entitled to a fair share of the results generated, both in economic terms and in terms of the knowledge produced (Saccaro Jr, 2011a). Thus, the CBD sought to establish a better balance in these relations, recognizing a range of rights related to sharing benefits generated by access to genetic resources to promote development and equity in the international system.
This research aims to contribute to understanding the challenges of designing and implementing ABS regulations and their possible effects on developing a sustainable bioeconomy, proposing the following research question: to what extent can the new Brazilian governance system passed in 2015 achieve different objectives necessary for an effective ABS1 regulation and why? This question unfolded into three other questions, referring to the purposes of this governance system:1) Can the Brazilian ABS governance system control access to genetic heritage and associated traditional knowledge efficiently?
2) Does the Brazilian ABS governance system contribute to promoting bioprospecting and sustainable uses of biodiversity?
3) Does the Brazilian ABS governance system ensure fair, equitable, and inclusive benefit sharing?Literature survey:
